The Florida Insurance Commissioner is Wary About Insurance Companies Using AI

PropertyInsurance

Artificial intelligence is slowly beginning to infiltrate virtually every aspect of our lives, and the insurance industry is certainly no exception. At first glance, it seems like an obvious move. After all, the insurance industry has always relied heavily on data. If an AI model can analyze that data faster and more efficiently, why wouldn’t AI companies take advantage of this? On the other hand, AI poses serious ethical concerns that the Florida insurance commissioner is now worried about. How can a property insurance lawyer in Fort Lauderdale help if you think your claim was unfairly denied by AI?

Florida Lawmakers Want Humans to Make the Final Decisions About Property Insurance

Many Florida lawmakers are uncomfortable with the prospect of artificial intelligence making final decisions about property insurance. The obvious example of a concerning situation involves an AI model denying a claim without any human intervention. The insurance company might argue that the AI model is inherently unbiased and accurate… But who oversees the AI? How do we know whether the insurance company has its finger on the scale (or programming, in this case), ensuring a favorable result for them?

Florida Insurance Commissioner Michael Yaworsky says that certain insurance companies are deploying AI more responsibly than others. This implies that he believes that some organizations are behaving irresponsibly or even unethically when using AI. He also stated that he believes human oversight is critical when it comes to AI in the insurance industry.

These thoughts are echoed by many Florida lawmakers. Some have introduced legislation that would mandate human oversight for insurance companies that want to use AI. Specifically, a human would need to make the final call over a denied claim if this bill passes.

The Insurance Commissioner did not specifically state that he agrees with this suggestion. However, he did say that insurance companies should have a human “in the loop” at some stage during the denial process. Ultimately, Florida lawmakers will decide what to do. His role is only to enforce the laws suggested and passed by lawmakers.

Of course, there is a strong incentive for insurers to downplay fears about AI’s role during claims handling. The widespread adoption of this technology could significantly improve their profit margins. Not only could it lead to greater accuracy, but it could also allow them to lay off countless human workers and replace them with AI programs.

Some, including the Insurance Commissioner, are concerned that many companies are simply adopting “off-the-shelf” AI solutions without really understanding how they work.
