Insurer Faces Allegations of Secretly Cutting Hail Damage Payouts

Plaintiff Claims Insurer Went Back on Its Word
One plaintiff states that after an adjuster agreed that his roof required replacing after a major hailstorm, the insurer then reversed course and abruptly denied the claim. Making matters worse, the insurer then suddenly dropped coverage for the homeowner. This left him without home insurance and without a functioning roof. Obviously, the man was under the impression that since he had been dutifully paying his premiums on time, the insurance company would have his back. He was wrong.
This individual managed to scrape together the funds to replace his roof. Then he hired a lawyer and sued the insurer for its conduct, discovering that many others had experienced exactly the same thing. Now the insurer is facing allegations that it had a secret policy to automatically deny all similar hailstorm claims. In one of these lawsuits, an employee ostensibly admitted that what it was doing was illegal.
The insurer has publicly denied all of these allegations. Some of these lawsuits speak of a coordinated, nationwide effort by the insurer to “slash payouts” for roof replacements dating back to 2020. After a year, the insurer expanded this “secret policy” to other states, including Florida. Property insurance lawyers working for homeowners say that the strategy involved using definitions and exclusions that never appeared in the policies.
The second strategy allegedly involved “coaching” and overseeing claims adjusters, ensuring that their independent assessments actually matched the company’s internal definitions (the same definitions that were absent from policies).

While hail damage to a roof might have been relatively rare a few decades ago, this is becoming a major issue for homeowners across the nation. Some believe that it has something to do with climate change. Around the same time that NPR published its report, Politico reported that states were forcing insurance companies to hand over their internal documents in order to better understand new, destructive weather events.
