AI Legislation Looms for Florida’s Property Insurance Industry

While AI has the power to transform virtually any industry, its potential effects on home insurance in Florida could be particularly profound. This industry thrives on data, and AI is capable of analyzing information on a scale that humans just can’t compete with. But is the use of AI in the property insurance industry really ethical? Is this something that we want? Lawmakers are considering whether to enact rules on AI for insurers, and this could potentially lead to future property insurance lawsuits in Fort Lauderdale.
Insurers Are Already Adopting AI at a Rapid Scale
In February of 2026, Tampa Bay 28 reported that one Florida insurance company was already implementing AI in major ways. Patriot Select is one of the newest insurers in the state, having just been approved last year. Although this organization is fairly small compared to larger insurers in the state, it is using AI to compete in a way that wouldn’t normally be possible.
On one hand, this is a good thing for consumers and property owners. More competition generally leads to lower prices, and if AI allows smaller insurers to compete with bigger, more established ones, this could lead to more choice for the average homeowner.
On the other hand, the involvement of AI in this industry raises troubling questions. What if your insurance claim is denied not by a human adjuster, but by an algorithm? What if your property insurer makes these decisions based on obscure data points that wouldn’t normally be relevant?
Representatives from Patriot Select say that AI can help them make decisions faster:
“We want to be put in front of more customers by independent agents, but we also want to be able to underwrite those customers quickly and accurately. So if we do have to say no we say no quickly and for a very clear reason, and if we say yes, which we rather do, we have the data we need.”
One method this company referred to was an AI system that uses publicly available aerial footage of roofs to distinguish “bad roofs” from “good roofs” without ever visiting the properties in question.
Lawmakers Debate How to Regulate AI in the Insurance Industry
Lawmakers in Florida are continuing to debate how to approach the concept of AI in the insurance industry. Some believe that claims should never be denied by purely AI systems, and human insurance workers should always have the “final say” in a denied claim.
