First party bad faith in Florida is controlled by statute. Some examples include, if the insurance company makes a misrepresentation as to the facts, or to the coverage under your insurance policy. If they make a payment without specifying what that payment is for, that can also be bad faith. Also, if they try to leverage one coverage against another. For example, if they say they will pay you additional living expenses if you accept their lower payment for the repairs to your home, that can also be bad faith.
