It depends. When a policy holder, or a homeowner or a property owner who wants to become a policy holder, goes to speak with an insurance agent and communicates to the insurance agent what the policy holder needs and the amount of coverage that they need, the insurance agent has a duty to communicate accurately and completely with the policy holder, or the person who wants to purchase a policy, to make sure that the policy holder gets the amount of coverage that they need. If it later turns out that the homeowner or property owner does not have the amount of coverage that they asked for, the amount of coverage that they expected, or that there’s some other question, you may have a claim. The policy holder may have a claim against the agent. To really analyze this issue, you need to make sure to speak with an attorney who is competent to handle claims against agents.
